Terms of Use

By accessing or using NightGlydersHub (the “Service”), any connected website, smart contract, or API we operate, you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the Service. We may update these Terms at any time; material changes will be announced on the site and take effect on the date posted above.

Trainer Points and Glyder Points are fictional in-ecosystem points that exist only within NightGlydersHub. They are not money, not a security, not a financial instrument, and not a cryptocurrency. They carry no monetary value, cannot be redeemed for fiat currency or cryptocurrency, and confer no right to dividends, profits, or any claim on the Service or its operators. They are non-transferable between wallets and may be added, removed, adjusted, slashed, expired, or discontinued at our sole discretion, with or without notice, for any reason including suspected abuse, game-balance changes, or wind-down of the Service.

Your Trainer Points and Glyder Points balances do not represent property rights. Any reference to balances, totals, earnings, or pricing is for in-ecosystem gameplay purposes only.

The Marketplace lets you redeem Trainer Points or Glyder Points for items curated by NightGlydersHub staff, including (without limitation) allowlist (“WL”) spots, digital wearables, NFTs, and physical merchandise. Items, supply, cost, availability, and fulfillment mechanics are set at our discretion and may change without notice.

All purchases are final. We do not offer refunds for Trainer Points or Glyder Points spent, except in cases of our own failure to deliver where no reasonable substitute is possible, and only at our discretion. You are solely responsible for providing accurate fulfillment information (Discord handle, email, shipping address, wallet address) at the time of purchase. Lost deliveries caused by incorrect information supplied by you are not our responsibility.

We may cancel a purchase and restore the spent points at our discretion if we discover fraud, exploit, mis-listing, or inventory error. Cancelled purchases carry no further obligation on either party.

You must be at least the age of majority in your jurisdiction and legally permitted to use blockchain services where you reside. You may not use the Service if doing so violates applicable law, sanctions, or the rules of any platform we integrate with.

You agree not to:

• Attempt to exploit, reverse-engineer, or abuse the points systems, accrual, chemistry, or marketplace mechanics.
• Use automated systems to flood endpoints, bypass rate limits, or create fake accounts or wallets.
• Interfere with signatures, idempotency keys, or any security measure.
• Use the Service to launder funds, evade sanctions, or for any illegal purpose.
• Sell, rent, or otherwise transfer Trainer Points or Glyder Points for consideration outside the Service. Such attempts are void and may result in slash of balances.

Violation of these rules may result in point slashes, account suspension, forfeiture of purchases, and/or permanent ban from the Service — all at our sole discretion.

Our staking is non-custodial. NFTs remain in your wallet at all times. We never request a transfer of your NFTs to stake them. If you list an NFT on a marketplace, transfer it, or wrap it into another contract, our systems detect this and apply penalties consistent with the published economy rules, including point slashes, rate reduction, loyalty recovery timers, and Glyder Points burn on transfer.

The Claw Machine is offered as a free, in-ecosystem game for entertainment purposes only. Participation is free. We never ask for, and will never accept, real-money payment — fiat or cryptocurrency — to spin, unlock, enter, or claim a prize. The only cost to pull is Trainer Points (TP) and/or Glyder Points (GP), both of which are earned through gameplay inside the Service and are subject to Section 2.

TP and GP are not for sale and not transferable. We do not sell Trainer Points or Glyder Points and you may not buy, sell, rent, trade, or exchange them with any third party for consideration of any kind. Any such attempt is void and may result in slash of balances, forfeiture of prizes, and a permanent ban from the Service.

The Claw Machine is a game. It should not be treated as gambling, an investment, a sweepstakes, a lottery, a contest of skill, or any other regulated activity. No purchase is necessary because nothing is being purchased — points are earned through gameplay, not bought. Outcomes are determined by a server-side random selection over a prize pool we curate. Odds, prize values, prize availability, costs per pull, the prize catalog, and the availability of the Claw Machine itself are set at our sole discretion and may change, pause, or end at any time without notice.

Prizes. Where a pull awards TP, GP, a profile banner, or a redemption code, fulfillment is automatic or handled through the Discord ticket flow described on win. All in-game credits are final once posted. Redemption codes are single-use and non-replaceable once revealed. Physical merchandise, allowlist (“WL”) spots, NFTs, and off-chain rewards are subject to the additional terms posted with the prize and to your providing accurate fulfillment information (Discord handle, email, shipping address, wallet address). We may cancel, substitute, or restore the spent points for any prize at our discretion where supply is exhausted, mis-listed, recovered for fraud or exploit, or where delivery is prevented by circumstances outside our reasonable control. Cancelled prizes carry no further obligation on either party.

Eligibility. You must be at least the age of majority in your jurisdiction and legally permitted to participate in random-prize games where you reside. If random-prize games of this type are restricted or prohibited where you live, you may not participate. You are solely responsible for determining whether your participation is lawful, and for any tax or reporting obligation that may apply to a prize you receive.

Limitation specific to the Claw Machine. In addition to Section 8, our total aggregate liability for any claim arising out of or relating to the Claw Machine is limited to the value of the TP and GP you spent on the affected pull(s), which — because TP and GP have no monetary value — is zero. The Claw Machine is provided “as is” without warranty of any kind. By pulling the lever you confirm you have read and agree to these Terms.

NightGlydersHub, the Glyder and Trainer art, the assembler pipeline, and all related branding are owned by us or our licensors. Ownership of a Glyder or Trainer NFT conveys only the licensing rights set out in the applicable NFT license (available separately). Nothing in these Terms transfers any trademark, copyright, or other intellectual property right except as expressly granted.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

Blockchain technology is experimental. Transactions are irreversible. We are not responsible for lost wallets, compromised keys, failed transactions, marketplace outages, indexer delays, or actions taken by third-party services.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL NIGHTGLYDERSHUB, ITS AFFILIATES, CONTRIBUTORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

You agree to indemnify and hold harmless NightGlydersHub and its affiliates from any claim, demand, loss, or damage (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party right.

We may add, remove, rebalance, or sunset features including Trainer Points, Glyder Points, staking mechanics, chemistry, training, the Marketplace, or any integration at any time. No feature is guaranteed to continue operating indefinitely.

These Terms are governed by the laws of the jurisdiction in which the operator is organized, without regard to conflict of laws principles. Any dispute that cannot be resolved informally will be resolved by binding arbitration on an individual basis; class and collective actions are waived to the maximum extent permitted by law.

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. These Terms, together with any other policies we publish on the Service, constitute the entire agreement between you and us concerning the Service.
